Dear Frank,

Thank you for that bit of wonderful news patting the boss man on the back, captioned “In case you missed it….”

In case YOU missed it, some time ago, I requested to put on the mailing list for REAL press releases from the governor’s office. However, I have noticed that others are getting the information and I’m not.

I know that is obviously an oversight.

Frankly (no pun intended), I don’t have a problem getting propaganda even though it is sent by this “reform” administration at taxpayer expense, but since I’m paying for it anyway, I want to get the real information.

I’ll be keeping a running account of how long it takes for you to respond.

Thus far, we’re going on 2 months that I have not gotten a response from your office. That’s a new record for me. Of course, I’ve only been communicating with governors’ offices since we used the Pony Express.

I’m glad Governor Jindal is a big supporter of government transparency. I can’t imagine how long it would take to get a response if he wasn’t.

Thanks for all you do in providing me with clippings from the media that praise our governor.

Our public officials seem incapable of doing anything to mitigate the rising cost-of-living in LA.

Our insurance rates are too high and rising. Our healthcare costs are too high and rising. The leges just spent more money on highways on which it is becoming too expensive to drive. It will mean that we can get to Bankruptcy Court on smoother roads.

Raises are being given to public employees to offset the cost of living increase. Yet, nothing has been done to make it easier for non-public employee, citizens to pay their bills.

Shocking ignorance

To my unpleasant surprise, I’ve learned in the last few days that our leges don’t know that they can repeal and reduce taxes in the 2008 Regular Session.

The law

Here is an analysis of the law that allows taxes to be repealed or reduced in 2008 Regular Session which starts on Monday, March 31:

LA Const. Article III, Section 2(3)(a) states, in part: “All regular sessions in even-numbered years shall be general in nature….” (emphasis mine).

That means unless otherwise prohibited by the state constitution, any measure can be introduced.

LA Const. Article III, Section 2(3)(b) limits what can be heard in such a session. The pertinent parts state: “No measure levying or authorizing a new tax by the state…; increasing an existing tax by the state…; or legislating with regard to tax exemptions, exclusions, deductions or credits shall be introduced or enacted….” (emphasis mine).

Tax exemptions, exclusions, deductions and credits while they have the effect of reducing taxes are NOT tax repeals or reductions (of rates).

If the intent had been to prevent the reduction of rates or the repeal in this Regular Session, the constitution would have used the language used for Regular Sessions in odd-numbered years. (See LA Const. Article III, Section 2(4)(b)).

Therefore, since this is a “general session” and since there is no prohibition against REPEALING or REDUCING taxes the leges can do so. They have to want to.

Tax reduction/repeal options

In the current (2007-08) fiscal year, there is (another) $1 BILLION in excess revenues that are recurring. Meaning that these additional revenues can be used to expand government or to reduce our tax burden.

To give everyone in the state some financial relief to deal with the rising costs of living, the State Sales Tax could be reduced by 1.5 cents to 2.5 cents.

To make LA truly competitive (and not merely less un-competitive) with the other states the State Corporate Franchise and Corporate Income Taxes can be repealed entirely.

These options do not require the constitutional “spending cap” be busted. It only takes a majority vote of each house of the Lege to repeal or reduce the taxes.

The ball is in the court of our leges. If they want to reduce taxes they can.

Insulting comment Tuesday, Mar 18 2008

In April 2007 in arguing against busting the constitutional “spending cap” Speaker of the House Jim Tucker, R-Algiers, made this comment:

“Our constituents made their intentions clear when they placed the expenditure limit in the Constitution — they want to limit the growth of state government.” Source: Baton Rouge Advocate.

Later, in June 2007 Tucker said the following:

“The people of this state are sick and tired of the history of this Legislature spending every single dime it gets its hands on as soon as it gets its hands on it.” Source: Baton Rouge Advocate.

In March 2008 in response to a question of his inconsistency because he was arguing for busting the the state “spending cap” Tucker made this comment:

“We are being completely consistent with our position. The problem is most people are ignorant when they don’t understand the subtle difference, but they’re very important differences,….” Baton Rouge Advocate, March 9, 2008.

In other words, if any of us mullets believe that Tucker is being inconsistent, we are simply ignorant.

As I see it, more spending is more spending and it is not “limiting the growth of government.” I can’t see the difference regardless of who is spending the money. That makes me ignorant according to Tucker.

A more appropriate response by Tucker might have been the one used by Governor “Big Daddy” Foster who said: I do change my mind occasionally. But a lot of times I’m pretty consistent.”
